IRS Form 5500 Deadline

The IRS Form 5500 and all required schedules and attachments must be filed “by the last day of the 7th calendar month after the end of the plan or GIA year (not to exceed 12 months in length).” The IRS provides different ways to file for an extension.

The IRS Form 5500 and all required schedules and attachments must be filed “by the last day of the 7th calendar month after the end of the plan or GIA year (not to exceed 12 months in length).” The most common way to obtain an extension is by filing IRS Form 5558 – Application for Extension of Time To File Certain Employee Plan Returns. The IRS revised IRS Form 5558 in June 2011.

CIGNA Corp. v. Amara, No. 09‐804, 2011 WL 1832824


The Supreme Court found in CIGNA Corp. v. Amara, No. 09‐804, 2011 WL 1832824 that the SPD terms are not an extension of the plan document for ERISA Section 502(a)(1)(B) purposes and cannot be enforced as if it were an extension of the plan document. This is contrary to previous precedent that more favorable SPD language generally trumps the plan document when there is a conflict.
